Food Fight Illegal? Five Students Face Charges
A recent 60-second food fight involving dozens of students at Kings High School in the Kings Local School District has resulted in criminal charges against five students.
The school resource officer, deputy sheriff John Fain, had no comment.
The principal, Thomas Higgins, said it wasn’t his decision to file charges.
The prosecutor, Rachel Hutzel, said she stands by her decision.
Two students were suspended from school.
Other parents have hired lawyers, so the food fight may end up as a court fight, Fuller reported.
Fain described the hot dog, ice cream and french fry toss as a “riot”.

Warren County Judge Dallas Powers is calling for the resignation of prosecutor Rachel Hutzel.
In a statement sent to 9News, Powers says Hutzel advised her nephew to refuse a field sobriety test at the time of his drunk driving arrest.
He said prosecutors are barred from giving legal advice to criminal defendants.
Hutzel’s 17-year-old nephew was pulled over in the Sterling Chase subdivision in Lebanon. Hutzel was called to the scene and that is where the judge alleges her breach of ethics.
Hutzel said she will not resign.

I think it is terrible waste of tax payers money, and a shame to ruin these boy records all because you have a young assitant tring to make something out of nothing. The story told by the officer was not complete. There is more but the family are afraid to say anything. I mean you are being prosecuted for throwing a hot dog. God help you if you were to speak your truth or peace. I just wish I could understand. We are hurting for TAXES, but we are wasting money for this.Governor Taft please look at this and tell me why. As a tax payer I don’t understand.
i got to Kings and i think this is a big calamity. there should be no reason the they were busted. 5 years ago with then state champion wrestler Jon Velez as a senior. they got in to a food fight at kings and all they had to do was come back after graduation and clean a few tables for like 3 days. this is a bunch of bull. Dep. Faine went over board with this. Its all a hunger battle for the school system to take over our lives. this needs to stop cops in schools should be there to protect not give out charges every 5 minute which happens at kings alot but thats another story for another Scandal.
i go to kings and my boyfriend was the leader of the food fight. Now first of all.. this wasnt meant to be anything serious just a little joke… plus it only lasted for what, like 60 seconds?? seirously.. this is totally rediculous, it blew my mind that officer fain # 1 threw a kid into a lunch table # 2 prosecuted my boyfriend and other students over a FOOD FIGHT? i mean come on.. # 3 lied.. and #4 got rid of the tape.. there are cameras all over the school they have everything on tape, and some how it was misteriously missing? a little suspitious i think.. i definately dont think this punishment fits the crime. they got SHAFTED!
first of all it was meant to be a big joke. earlier that week i got hit with a chicken nugget in the face. so we set it up for friday at 1241. when friday came we noticed that it was an early release day so i left my class early to get the girls to change the announcements because on early release days we have our “C” lunch at an earlier time. Therefore i told the girls to say ” 12:01 the magic minute” over the annoucements, that was our code saying for when the foodfight would start. so i went to lunch a few bells later and went through the line. my buddy and i tried to get the messiest stuff that you can buy. i got a chili dog and french fries. a sundae, slushie, mashed potatos, and bostco sticks with the sloppy sauce.. so some time passes buy and practicly the entire lunch room is staring at the clock waiting for 12:01 to hit the clock. then at 12:00 i looked at the entrance to teh cafeteria and saw about 50 kids atleast who must’ve skipped class, and were outside waiting to either join, or watch the foodfight. Then 12:01 hits and someone in the room screamed ” FOOD FIGHT” .. i threw two fries and a yogart cup came over my sholder and it hit the freshman behind me .. i then took a bite of my chilly dog, cocked my arm back , and hit a sophmore right in the face.. i finished off my tray.. got up and calmly walked out of the room while the food fight was still in action.. for the additional 5 SECONDS it lasted.. i ran and hid in the mens room as i heard officer faine escort my friend with his hands tightly behind his back to the office using profanity.. a few minutes passed by and i went down to the office to turn my self in.. and let me tell you.. honesty does not go far.. i got 10 days suuspention and possibly not able to walk at graduation, i also was no longer captain of my LAX team and was rejected to OHIO STATE due to my actions. 3 days later i got a leter in the mail saying was being porsecuted for ” inciting a riot” .. it said that i failed to stop when the police officer asked me.. which by the way isnt true because i was out of the cafeteria before he even knew what was going on, so we went to court and the court offered a plea bargin and just like two of the others i plead guilty.. but to a lesser charge. i wouldnt be introuble if officer faine didnt press charges over something rediculous. if he would have never done this to any 5 of us. my senior year would be going great right now. i just can’t believe this.. im glad its over.. faine would have his job if he wasnt such a crooked cop. this case is closed.
It’s very simple. School resource officer + CYA + untruths + county prosecutor who doesn’t seek the truth = Convictions of 5 students who did not deserve these outrageous criminal charges.
That’s it in a nutshell, but nobody cares. My son learned a lesson, alright. He learned that when in doubt, lie. Telling the truth will get you criminal charges. Who would have thought?
Frankly i think that the whole thing is just a big waste of time and money! I mean honestly do you really think that a stupid food fight is a big thing. i guess that it just because kings is too poor and somehow we needed the money? i dont know but answer me this.. why is it that the tape woulnd up missing and how is it that officer faine (though he shouldn’t be called an officer since he doesnt even uphold the law) was told not to press charges yet he did and mr. higgins (may he rest in peace) how come he erased the tapes? and why is Racheal Hutzel So Stupid ? oh yeah you look real cool prosicuting 5 kids for a flippin food fight. real nice!
This is to all the people that think that a food fight in a school cafeteria is trivial. Are you kidding me? Yes, food fights are an assault on other people. Yes, sharp edges of food containers can injure and hurt others…A LOT! The kids invloved should be arrested. Good Job Racheal! The stupidity is coming from those of you that think any kind of “fight” is OK.
No “containers” were thrown. Some hot dogs, french fries and a couple chicken nuggets were tossed. Arrested? Please. Someone get a grip. These kids should have been disciplined by the principal, not the county prosecutor. She spent three days in closed door meetings with the administration to file rioting charges against these kids, while real criminals were shooting at housing developments in Waynesville, and it was ignored.
It has backfired in this community.
